1. Who you are contracting with

The Boardside System (the "Service") is provided by Michelle McHale, trading as Boardside Living ("Boardside", "we", "us"). By creating an account or continuing to use the Service you agree to these Terms & Conditions. If you are using the Service on behalf of a household or organisation, you confirm you have authority to accept these terms on its behalf. If you are an individual, you confirm you are of legal age to enter this agreement.

2. The Service

The Boardside System is a subscription web application that gives a household one shared calendar, ownership assignments, meal and school-lunch systems, tournament prep, seasonal planning, and a weekly reset. Access is granted per household on the plan you select.

A subscription unlocks the Service for the members of your household who have been invited to your household account.

3. Your account

You must provide accurate information and keep it up to date. You are responsible for keeping your login credentials confidential and for all activity that happens under your account. Tell us promptly if you believe your account has been accessed without your permission.

4. Acceptable use

You must not:

  • use the Service for any unlawful purpose;
  • use the Service for fraud, spam, or harassment;
  • infringe anyone's intellectual property or privacy rights;
  • interfere with the security or integrity of the Service — no malware, probing, penetration testing, scraping, or automated bulk access;
  • reverse engineer, resell, redistribute, or circumvent technical or plan limits;
  • upload content about children or other family members that you have no right to share.

5. Licence and intellectual property

We grant you a limited, non-exclusive, non-transferable right to use the Service for your own household during your paid subscription. We retain ownership of the Service, the software, the Boardside System framework, the worksheets, the documentation, and all Boardside branding.

You keep ownership of the content you enter — your calendar entries, meals, notes, and lists. You grant us a limited licence to host, store, and process that content solely to provide the Service to you.

6. Payment, billing, and cancellation

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. Subscriptions renew automatically on a monthly or annual cadence depending on the plan you choose, until cancelled. When you cancel, your access continues until the end of the period you have already paid for. Plan changes take effect at your next renewal. Refunds are covered by our Refund Policy.

7. Service level

We work to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free performance. The Service may be unavailable during maintenance, updates, or events outside our control. The Service is a planning tool — it is not a substitute for your own judgement about your family's schedule, safety, or care.

8. Suspension and termination

We may suspend or terminate access where there is a material breach of these terms, non-payment, a security or fraud risk, or repeated or serious policy violations. Where it is reasonable to do so, we will give notice and a chance to fix the problem first.

You may stop using the Service at any time by cancelling your subscription. After your access ends you may request an export of your household data for 30 days, after which the data may be deleted.

9. Warranties and liability

To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We are not liable for indirect, consequential, or special damages, including lost profits, lost data, or lost goodwill. Our total aggregate liability is limited to the fees you paid in the twelve months before the claim. Nothing in these terms excludes liability for fraud, death, or personal injury caused by negligence, or any other liability that cannot be excluded by law.

You agree to indemnify us against claims arising from your content, your unlawful use of the Service, or your breach of these terms.

10. Changes to these terms

We may update these terms. Where changes are material we will give reasonable notice through the Service or by email. Continued use after the change takes effect means you accept the updated terms.

11. General

These terms are governed by the laws of the State of New York, United States, and the courts of that jurisdiction have exclusive jurisdiction over any dispute. You may not assign this agreement without our consent; we may assign it as part of a merger, acquisition, or sale of assets. Neither party is liable for failure to perform due to events beyond its reasonable control.
